Marco Antonio Hernández Bautista was detained by four policemen from San Juan Mixtepec, Oaxaca; the next day he was found dead and with signs of torture
OAXACA. Once again, the Oaxaca police face murder charges.
In this case, the victim is the indigenous Mixtec Marco Antonio Hernández Bautista, who was allegedly detained, tortured, and killed by the municipal police of San Juan Mixtepec, according to the president of the Center for Human Rights and Counseling for Indigenous Peoples, Maurilio Santiago Reyes. .
Hernández Bautista was arrested on October 25 by four elements of the municipal police and a day later he was found dead with signs of torture in a spot on the road to Las Huertas.
In this case, the municipal president of San Juan Mixtepec, Pablo Santiago Bautista, and the trustee, Paulino Paz Hernández, have become cover-ups for the police by attempting to distort the facts.
Soledad Bautista Chávez, the mother of Marco Antonio Hernández Bautista, denounced that on October 25, around 5 in the afternoon, four elements of the municipal police of San Juan Mixtepec detained him and, according to several witnesses, took him to the city Hall.
And, a day later, on October 26, at approximately 10 in the morning, the lifeless body of Marco Antonio appeared, with signs of torture and physical violence in the area on the way to the orchards San Juan Mixtepec, Juxtlahuaca, Oaxaca.
He mentioned that his 32-year-old son was the one who contributed to the family’s expenses because he was engaged in the fields and construction, and was about to migrate to the United States because he was already selected to go to work in Tennessee in the middle of the month of December.
Before, in 2014 he emigrated to Ensenada, Baja California; Then, in 2015, with an eight-month work visa, he traveled for the first time to the United States, where he worked in the fields in Washington, and in 2016 he returned to the United States with a work visa.
However, in 2018 he returned to his town, where he dedicated himself to working in the fields, sowing and growing corn, as well as dedicating himself to construction work with the intention of being able to make his savings and build his own house and waiting for the time to travel to the United States again.
But this dream will no longer be possible because, according to his mother, the municipal police of San Juan Mixtepec killed him, the municipal authority protected the alleged criminals and the Oaxaca General Prosecutor’s Office put up a lot of resistance to integrate the investigation folder 33013 / FMIX / JUX / OAX / 2020.
That is why the relatives of Marco Antonio and the Center for Human Rights and Counseling for Indigenous Peoples speak out for the clarification of this crime allegedly committed by municipal police in the state of Oaxaca.
The family complained that the municipal trustee “simply said he had no report. We insist that there were witnesses that my brother was arrested and put into the presidency. Then he said: don’t worry, go bury the dead man and we talked calmly to see how we can help him ”.
“Then we came back and he said no longer because there was no report. He detaches himself from everything. He simply said ‘do what you want, go where you want, you won’t be able to do anything with me’. That is why we demand justice. It can’t be that they arrested my brother and then we found him dead. “
In the same way, the family went to the Juxtlahuaca Public Ministry, and there, the lawyer Nicolasa said that there was no crime to prosecute. That we go back to town and talk to the trustee. Nothing will be done here. Almost begging them, we asked him to attend us and make a formal complaint. In the end, he agreed to file the complaint, but there is no progress ”.
The unfortunate thing is that “the authority that is there to take care of the people hurts them and the police continue to work as if nothing happened.”
And they warned that if something happens to them, they hold the authorities and the organization called Red Indígena Internacional de Oaxaca (RIIO) responsible because by denouncing and demanding justice “we know the risk we are running.”
As a family, they will continue to demand justice because, although the autopsy says that he died of drowning, “why don’t they say how he drowned and why they went to throw him away? Besides, there are signs that he was mistreated.”
Finally, they warned that “we are not going to be intimidated by the authorities and we are going to defend ourselves at any cost, we do not like to be humiliated so much.”

Santiago Reyes recalled that in 2020 the cases of police abuse increased in the different municipalities in the state of Oaxaca, and he listed:
The case of soccer player Alexander Martínez Gómez, 16 years old, who was killed by elements of the Acatlán de Pérez Figueroa municipal police on June 9, 2020.
In addition to the cases of Jacciel LP, who survived, but his brother Diego LP did not have the same luck and died after they were tortured by the municipal police of San Pablo Huitzo, on May 6, 2020.
In this case, the municipal trustee, Martha Isabel H., as well as the police officers David H., Abraham FM, Luis A., and Manuel V. are directly involved.
Similarly, the case of Ángel Daniel Bautista Vásquez was documented, who was tortured by elements of the municipal police of Tlaxiaco on March 21, 2020.
As well as the case of Raúl Sánchez Martínez, who was tortured by elements of the Ejutla de Crespo municipal police on October 15, 2020.
